A. I picked the side of New Jersey in the New Jersey vs. T.L.O instance. The ground I picked that side is because the miss whas smoke on school evidences and she was non allowed to make that. Another ground is the instructor that found the miss smoke had the right to convey her to the Principals office, because she had a ground to. Finally the miss denied smoke, she said she didn? t fume and she likely would of got in less problem if she told the truth.

B. A miss was caught smoke in a shcool bathroom. A instructor caught her and took her to the Principals office to be searched. The vice-principal found more than merely coffin nails, they besides found turn overing documents, marihuanas, a pipe, a big sum of hard currency, and an index card with a list of pupil names and sums of money owed to her. The Juvenille Court prosecuted T.L.O for drug dealing. T.L.O ploted that the hunt was unconstitutional and was interrupting her rights under the 4th amendment. Juvenille Court still thought that it was alright to seek her bag because the school had a leery ground for perpetrating a offense. The instance so went to the Supreme Court, they ruled that the school by any agencies had the right to seek T.L.O

C. The New Jersey High School had the right to seek T.L.O. The Fourth Amendment

state? s that cipher has the right to seek person for no ground unless there is a likely cause. For that means the school had no ground to seek the miss. The jurisprudence for seeking in a school is different. You are allowed to seek merely if you have a ground. For that means the school did hold a ground.

The school besides had the right to seek the miss, because a instructor found the miss smoke in the bathroom, It clearly says that smoking was non allowed on school evidences. On top of that the miss lied about smoke. That makes everything worse for the miss. The instructor found the miss smoke in the bathroom, but T.L.O denied it, in the hunt the Vice-President found coffin nails. That has got to intend she fumes.

D.If I were the opposing position I would believe the hunt was incorrectly because there was no likely causeand there was no grounds for her smoke. The school could of taken a breath cheque or some indicant that she was smoking. I would hold got huffy because the coffin nail could hold been person elses and it merely was on the land when the instructor saw it.

E. I thought the hunt of T.L.O was constitutional and if person was smoking and she was caught I would seek that person merely for the better of the school and the Students. All hunts on a school country are illegal unless there is a ground.
